About

Originally from not really anywhere (my dad was Air Force), I am now living in Star Valley, Wyoming, and loving it.  I am a licensed attorney in Utah, Wyoming, and Idaho, doing limited pro bono work through a few agencies, family law consulting, and taking cases that are uncontested in divorce, paternity, and adoption.  I also do very very basic estate planning in Utah–consisting of simple wills, advanced healthcare directives, powers of attorney, and springing powers of attorney.  I’m currently working with Lubing & Gregory, LLC, in Jackson, Wyoming, and I’m working firm cases, handling very limited domestic cases, and learning a whole lot more about different areas of the law.  Some of what I learn very well may end up on this blog.

If you have questions about any type of family law, try searching for answers on the blog and in the links, but you can email me if you can’t find what you’re looking for–marca.tanner@gmail.com.

There are a few purposes for this blog:

First–to help you learn a little about the law, sometimes as I learn it.  You can learn from my (sometimes bad) choices and my (not so fun) experiences.  The best part about about being a lawyer is helping people.  I’m hoping this blog will help some people avoid making the mistakes I have made.

Second–I am desperately hoping and praying that I can bring some civility back to family law.  I’m afraid that when we are dealing with broken hearts and broken families, we become vicious and irrational.  We end up hurting each other and our kids so much more than is really necessary.  Face it–there will be some hurt.  Your lives will never be the same again.  That does not mean they cannot be livable, or even better.  I pray that I can help people find that Livable, Better place, that does not come from trying to destroy another or control them out of pain and fear.  We are all too good for that.

Third–My life did not go the way I thought it was going to when I was a kid in high school/college/etc… I’ve learned, and continue to learn, a lot of things about myself, what I’m passionate about, what I’m NOT, who I am, and how to deal with my own personal issues that have arisen as a result of this life I’ve been living in for a couple of decades or so.  I know I’m not the only one.  Hopefully I can touch on things that you understand, too.

Just wondering what your thoughts on the gay marriage ruling. Have you read the opinion yet?

I haven’t read the ruling yet. I know I personally think that the government should get out of the marriage business as an impermissible mixing of church and state, and disallowing a segment of the population to enter into a marriage, because of the legal ramifications, amounts to a violation of the 14th amendment’s equal protection clause.

Personally I think marriage is a violation on the separation of church and state doctrine and therefore all marriage is invalid. The State can only give out civil union certificate and if the couple wants their union being called a marriage, they need to get the church to certify it.

That works too. I’m right there with you on this. I think that would solve all of the issues that are wrapped up in this.

Apparently there was one benefit of issuing marriage license to the gay couples. The county rake in $49,000 in three days for granting marriage license. (Newspaper did not say which county!)

And now they have rights when their marriages break up and they get divorced, too… Yippee :/. I heard of a lawyer in New York saying that he supports gay marriage because that means he’ll have more divorce business. Lawyers can be quite a jaded bunch.

LOL! He is right! I wouldn’t call it jaded, I would called it great business sense! LOL! I wonder what happen if a gay couple who got married in another state is seeking a divorce right now, technically speaking, Utah court has to accept filing for divorce.

Got a notice from the family law section stating they are having a CLE on the same-sex marriage ruling in Utah. Are you planning to go? It is in downtown Salt Lake.
